The Oscars

To enter and participate in this Sweepstakes, you must agree to and abide by these Official Rules.

NO PURCHASE NECESSARY TO ENTER OR WIN. You must have Internet access and an active e-mail account to participate.

1. Eligibility: The Ultimate Oscar® Red Carpet Fan Experience Sweepstakes ("Sweepstakes") is open only to legal residents of the 50 United States and Washington D.C., who are at least 18 years of age (or the age of majority in the jurisdiction of their residence, whichever is older) and who have an active e-mail account and Internet access as of 1/9/13. Employees of American Broadcasting Companies, Inc. (“Sponsor” or “ABC”), the Academy of Motion Picture Arts and Sciences, LeadDog Marketing Group, Inc. (“Administrator”), each of their respective parent, subsidiary, related and affiliated companies, and persons involved in the development or production of The 85th Academy Awards, and the immediate family and household members of all such foregoing individuals, are not eligible to enter or win. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live. "Household members" shall mean people who share the same residence at least three (3) months a year, whether related or not. Potential winner may be required to provide proof of eligibility upon request prior to prize award. Void where prohibited or restricted by law.

   Entrants may not have been convicted of a felony. Each entrant understands and agrees that, if selected as a potential Grand Prize winner, he/she and his/her guest will be required to consent to a background check; and, failure to sign such consents and authorizations and/or to furnish all required information will result in disqualification. In addition, Sponsor reserves the right in its sole discretion, to disqualify a potential Grand Prize winner and/or his/her guest if the results of such background checks reveal that a potential Grand Prize winner is not eligible to participate in the Sweepstakes and/or a potential Grand Prize winner’s guest has been convicted of a felony.

2. Sweepstakes Entry: The Sweepstakes begins on or about 12:00:01 a.m. (midnight) PT on 1/10/13 and ends 12:00:00 p.m. (noon) PT on 2/1/13 (“Promotion Period”). Administrator's computer is the official clock for this Sweepstakes.

   To enter, visit www.UltimateFanExperienceSweepstakes.com (“Website”) and complete the Sweepstakes entry form. You will be asked to provide your name, e-mail address, date of birth, zip code that you live in, and phone number. You may be asked to consent to receive promotional e-mails and reminder e-mails from Sponsor and/or third parties. Consenting to receive promotional or reminder e-mails is optional and does not have to be agreed upon in order to be eligible to participate in the Sweepstakes and does not improve your chances of winning.

   Click the check box signifying that you have read and agree to ABC’s Terms of Use and Privacy Policy. IF YOU DO NOT CHECK THE BOX INDICATING YOUR AGREEMENT TO ABC’S TERMS OF USE AND PRIVACY POLICY, YOU WILL NOT BE ENTERED IN THE SWEEPSTAKES AND CANNOT WIN THE PRIZE.

   Limit one (1) entry per person per day during the Promotion Period, regardless of the number of email addresses a person may have. For the purposes of this Sweepstakes, a “day” is defined as beginning at 12:00:00 a.m. (midnight) PT and ending at the following 11:59:59 p.m. PT (except for the first day of the promotion, which begins at 12:00:01 a.m. (midnight) PT, and the last day of the promotion, which ends at 12:00:00 p.m. (noon) PT).Multiple entries in excess of this limitation or mass entry attempts will result in disqualification of all entries by such person. Entries must be manually key-stroked by the entrant; use of automated entry devices or programs, or entries by third parties, are prohibited. Incomplete entries will be disqualified. Proof of entering information at the Sweepstakes website or entry form is not considered proof of delivery to or receipt by Sponsor of such entry. Personal information collected in connection with this Sweepstakes will be treated in accordance with Sponsor’s privacy policy, available at http://corporate.disney.go.com/corporate/pp.html .

3. Random Drawing: : A potential winner will be randomly selected on or about 1:00:00 p.m. PT on 2/1/13. Drawing will be conducted by LeadDog Marketing Group, an independent judging organization/Administrator whose decisions are final and binding on all matters related to the Sweepstakes.

4. Winner Notification: A potential winner will be notified by e-mail on or about 2/1/13. Failure to respond to the initial verification e-mail within 3 business days after transmission to the potential winner or return of the e-mail notification as undeliverable after 2 attempts will result in disqualification and award of the prize to an alternate winner. Potential prize winner will be required to complete, sign and return, within 3 business days of transmission, an Affidavit of Eligibility, a Liability Release and Indemnification, and a Publicity Release, where allowed by law, and the necessary paperwork for a background check (collectively “Prize Documents”). If Prize Documents are not returned to Administrator within the specified time period, or if any prize notification or prize is returned as non-deliverable, or if potential winner is found to be ineligible or otherwise not in compliance with these Official Rules, or declines the prize for any reason prior to award, prize may be forfeited and potential winner may be disqualified. If a potential winner is disqualified for any reason, prize will be awarded to an alternate winner selected from all remaining eligible entries received during the Promotion Period, provided sufficient time remains prior to the 85th Academy Awards. The winner’s guest must also complete, sign and return a travel release and the necessary paperwork for a background check prior to issuance of travel documents. In the event of any dispute concerning the identity of any entrant, the entry will be deemed submitted by the natural person who is the authorized holder of the transmitting e-mail account. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

   Sponsor and its agencies are not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software. If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud or technical failures beyond Sponsor’s control that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to terminate, modify or suspend the Sweepstakes. In such event, Sponsor reserves the right to conduct the Sweepstakes and award the prize by means of a random drawing comprised of all eligible entries received prior to and/or after (as appropriate) the action taken by Sponsor or otherwise award the prize in a manner which is fair, appropriate and consistent with these Official Rules, as determined by Sponsor in its sole discretion. Notice of termination/modification/suspension of Sweepstakes will be posted on the Website. No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or loss, destruction or unauthorized access to, or alteration of, entries; or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or electronic entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to entrant's or any other person's computer related to or resulting from participation in or downloading any materials from this Sweepstakes.

   Entrants further agree not to knowingly damage or cause interruption of the Sweepstakes and/or prevent others from participating in the Sweepstakes. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY ENTRANT MAKING SUCH ATTEMPT AND SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW.

5. Prize, Approximate Retail Value ("ARV") and Odds:

   Grand Prize (1 winner): Grand Prize winner will receive a trip for two (2) to Los Angeles, CA and tickets to sit in the bleachers next to the red carpet arrival area at the 85th Academy Awards on February 24, 2013 (“Trip”). Grand Prize Trip consists of round-trip coach class air transportation for two (2) to Los Angeles, CA from an airport near winner’s residence (as selected by Sponsor in its sole discretion); two (2) nights’ hotel accommodations (one room, double occupancy) at a Los Angeles area hotel (as selected by Sponsor in its sole discretion); ground transportation between Los Angeles airport and hotel; two (2) tickets to the bleacher section next to the red carpet arrival area at the 85th Academy Awards; $300.00 cash or cash equivalent gift card for Trip (i.e. gift card to be determined by Sponsor in its sole discretion; gift card is subject to terms and conditions thereon); and an Oscars gift bag consisting of the 2013 Program and Oscars merchandise such as a hat and sweatshirt (specific items in gift bag to be determined by Sponsor in its sole discretion).

   ARV of Grand Prize: $2,500.00.

   GRAND PRIZE DOES NOT INCLUDE ADMISSION TO THE 85TH ACADEMY AWARDS CEREMONY.

   If Grand Prize winner is unable to travel to Los Angeles between February 23-25, 2013 for any reason, Grand Prize will be forfeited in its entirety and an alternate Grand Prize winner may selected from among all remaining eligible entries received, provided sufficient time remains prior to the 85th Academy Awards. In the event the Grand Prize Winner is able to participate in the Trip during the dates designated by Sponsor but the 85th Academy Awards or bleacher seat portion of the event does not or cannot take place as scheduled or at all, for reasons including but not limited to cancellations, postponement, location changes, an event of force majeure, or for any other reason, then Sponsor reserves the right to award the remainder of the prize with no further obligation to the winner.

   The winner’s guest must be at least 18 years of age (or the age of majority in the jurisdiction of their residence, whichever is older). Winner is not entitled to exchange, substitute or transfer prize or portions thereof except with Sponsor’s permission or where required by law. Academy Awards bleacher seats are non-transferable and have no retail value. Winner and guest must travel together on same itinerary. Winner and guest assume the risk of any inherent or unforeseen dangers associated with travel. All air transportation tickets are subject to the vagaries of flight variation, work stoppages and schedule or route changes. ARV for travel prize may vary depending upon points of departure and destination and flare fluctuations. If for any reason announced prize (or prize component) becomes unavailable, Sponsor may award a substitute prize/prize component of equal or greater value. Prizes are not redeemable for cash. All taxes associated with the Grand Prize are the sole responsibility of the winner.

   Winner and guest must follow all instructions of Sponsor and its designees relative to Trip. Should winner and/or guest to fail to adhere to any such instructions or engage in unruly, obnoxious, illegal, threatening, or otherwise inappropriate behavior (as determined by Sponsor in its sole discretion), Sponsor and its designees reserve the right, without further notice or warning, to terminate the Trip or other applicable experience early, in whole or in part, and send the winner and/or guest home and/or take other actions as Sponsor and its designees deem appropriate in their sole discretion without any liability or other obligation to winner or guest.

   Sponsor makes no warranty, representation, or guarantee, express or implied, in fact or in law relative to the use of any prize or portion thereof, including, without limitation, its quality, merchantability or fitness for a particular purpose. The preceding excludes any express or legally required warranties on the products included in the Grand Prize; such warranties being limited by their stated terms/conditions.

   By accepting a prize, each winner grants Sponsor and its designees permission to use their name, voice, likeness, photograph, prize information, biographical data and city and state of residence on a winner's list (if applicable) and for programming, publicity and promotional purposes, worldwide in all forms of media now known or hereafter developed, in perpetuity, without further compensation unless prohibited by law. Sponsor and its designees are not obligated to use any of the above mentioned information or materials, but may do so and may edit such information or materials, at Sponsor's sole discretion, without further obligation or compensation.

   Odds of winning the Grand Prize depends on total number of eligible entries received during the Promotion Period.

6. Conditions and Limitations of Liability By participating in this Sweepstakes, each entrant agrees: (a) to be bound by these Official Rules and the decisions of Sponsor, which shall be final in all respects; and (b) to release, discharge and hold harmless Sponsor, the Academy of Motion Picture Arts and Sciences, LeadDog Marketing Group, Inc., each of their respective advertising and promotion agencies and prize suppliers, any entity responsible for the administration of this promotion, each of the foregoing entities’ respective parent, subsidiary, related, affiliated and successor companies, and each of their respective officers, directors, agents, representatives and employees, as well as each of their respective successors, representatives and assigns (collectively, the "Released Parties") from any and all actions, claims, injuries, losses or damages, including, without limitation, death and bodily injury, arising in any manner, directly or indirectly, in whole or in part, from participation in this Sweepstakes, any Sweepstakes-related activity and/or entrant’s acceptance, receipt, use or misuse of any prize (including without limitation, any travel related thereto). Sweepstakes subject to the laws of the United States only. All federal, state and local laws and regulations apply. All submissions become the property of Sponsor and will not be acknowledged.

7. Disputes: Arbitration/Choice Of Law: Except where prohibited, entrants agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, or the determination of winner, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to the Rules of the American Arbitration Association, then effective; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for and entrant hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and/or Released Parties in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, without regard for conflicts of law doctrine of New York or any other jurisdiction, and all proceedings shall take place in the City of New York, County of New York.
